ICBC
often publishes promotional material stating that it follows a policy of
being "fair and reasonable" in settling personal injury
claims. Any attempt by a person injured in a motor vehicle accident to
seek a better offer, or retain counsel is labeled as "legal
wrangling". If "legal wrangling" means to attempt to
obtain settlements or judgments for our clients that are consistent with
the law of this province, as opposed to the much lower ICBC internal
guidelines, then, at Dick Byl Law Corporation, we confess that we do
this a lot.
There
is a simple exercise that you can follow to get a better understanding
as to how ICBC deals with personal injury victims. Ask your adjuster
what he or she thinks the value of your claim is. Then come and ask us.
We do not charge for such a consultation. If you wish to have us handle
your claim, we will do so in a friendly, courteous manner. We do not
require any funds from you, and we only charge a percentage of what we
collect. We will send you one bill and one bill only, at the conclusion
of your case. If there is no judgment or settlement, there is no bill.
We
act in your best interest. Your adjuster acts in the best interest of
ICBC. ICBC hires lawyers to represent them. Other law firms act for ICBC
on some files and against ICBC on others. We NEVER act for ICBC! Our
